GROUNDS FOR ISSUANCE OF AN EPO
Family Code 6250 A judicial officer may issue an ex-parte emergency protection order where a law enforcement officer asserts reasonable grounds to believe any of the following: (a) That a person is in immediate and present danger of domestic violence based on the person’s allegations of a recent incident of abuse or threat of abuse by the person against the order is sought. (b) That child is in immediate and present danger of abuse by a family or household member, based on an allegation of recent incident of abuse or threat of abuse by the family or household member. (c) That a child is in immediate and present danger of being abducted by a parent or relative, based in a reasonable belief that a person has an intent to abduct the child or flee with the child from the jurisdiction or based on an allegation of a recent threat to abduct the child or flee with the child from the jurisdiction. (d) That an elder or dependant adult is in immediate and present danger of abuse as defined... IMPORTANT! AN EMERGENCY PROTECTIVE ORDER IS ONLY IN EFFECT FOR A DAY OR TWO; YOU MUST FILE AN APPLICATION FOR A PERMANENT ORDER BEFORE YOUR EPO EXPIRES TO PROTECT YOURSELF FROM FURTHER ABUSE. BASES PARA QUE LE DEN UN EPO Codigo de Familia 6250 Un oficial judicial puede darle una orden de protección de emergencia de una parte en donde el oficial de la fuerza de ley sostiene bases razonables para creer en cualquiera de lo siguiente: (a) Que si la persona esta en un peligro imediato y presente de violencia domestica basado en las alegaciones de la persona sobre un incidente reciente de abuso o amenaza de abuso hecho por la persona por la cual se produjo la orden. (b) Que el niño esta en un peligro imediato y presente de violencia domestica basado en las alegaciones de la persona sobre un incidente reciente de abuso o amenaza de abuso hecho por la familia o un miembro de la casa. (c) Que el niño esta en un peligro imediato y presente de ser arrebatado por un padre o familiar, basado en la creencia razonable de que la persona tiene el intento de arrebatar al niño o viajar con el niño fuera de la jurisdicción o basado en la alegación de una amenaza reciente de arrebatar al niño o viajar con el niño fuera de la jurisdicción. (d) Que alguien mayor o un adulto independiente esta en un peligro imediato y presente de abuso como esta definido... IMPORTANTE! UNA ORDEN DE PROTECCION DE EMERGENCIA ES SOLO EN EFECTO POR UN DIA O DOS; USTED TIENE QUE ARCHIVAR UNA APLICACION PARA UNA ORDEN PERMANENTE ANTES DE QUE SU EPO SE VENZA PARA PROTEGERSE DE ABUSO FUTURO. |
